MINUTES OF THE BOARD OF COMMISSIONERS’ MEETING
HELD ON APRIL 26, 2010

The Board of Commissioners of the Village of Palos Park, Cook County, Illinois held its regular meeting on Monday, April 26, 2010. Mayor Mahoney called the meeting to order at 7:31 p.m. Answering to roll call were Commissioners Milovich-Walters, Polk, O’Connor, and Mayor Mahoney. Commissioner Pavlatos was not in attendance.

Also in attendance were Carol Bryson, Village Clerk; Patricia Jones, Village Administrator; Tom Bayer, Village Attorney; Joe Miller, Police Chief; Barbara Maziarek, Finance Director; Steve Manning, Community Development Director; Kathy May, Deputy Clerk; Nicole Marxman, Recreation Director; Sally Kinney, Secretary to Mayor Mahoney; and Cathy Gabel, Deputy Clerk.

RECOGNITION OF EAGLE SCOUT KYLE GRABEN: Mayor Mahoney recognized Kyle Graben with a Certificate of Recognition for his tremendous effort in achieving Eagle Scout. Kyle received the rank of Eagle Scout in a ceremony held on Sunday, April 18, 2010 at the Palos Park Presbyterian Church. Kyle has been in scouting since first grade. He has traveled extensively and earned thirty-six merit badges. Kyle’s Eagle service project was designing, building and installing a display case for the Sandburg High School Music Department to showcase awards and trophies from the Sandburg Music Department.

BOND ISSUE NOTIFICATION ACT PUBLIC HEARING: The Village Council held a public hearing for the purpose of receiving public comment on the proposal to sell bonds in the amount of $1,750,000 for the purpose of paying the cost of expanding the existing underground water reservoir. With no comments from the public, Mayor Mahoney closed the Bond Issue Notification Act Hearing at 7:37 p.m.

APPROVAL OF MINUTES OF THE REGULAR COUNCIL MEETING HELD ON APRIL 12, 2010: Commissioner Polk moved, seconded by Commissioner Milovich-Walters, to approve the minutes of the Regular Council Meeting held on April 12, 2010 as presented.

COMMISSIONERS’ REPORTS:
COMMISSIONER OF PUBLIC WORKS/RECREATION, NICOLE MILOVICH-WALTERS:
PUMP STATION AND WATER RESERVOIR EXPANSION PROJECT UPDATE: Commissioner Milovich-Walters reported all excavation and shoring is complete for the reservoir expansion project. Stone base has been laid for the reservoir floor slab. Steel was delivered on Friday, April 23rd for the reinforcement of the concrete slab. AT&T began relocating overhead wires. Airy’s, Inc. is scheduled to finish the installation of the steel reinforcement for concrete floor slab, pour concrete floor slab and continue interior electrical work.

APPROVE PAYING ADDITIONAL COSTS WHICH MAY BE INCURRED FOR AN INCREASE IN ASPHALT COSTS AS A RESULT OF POSTPONING THE 121ST STREET PAVING PROJECT TO K-FIVE CONSTRUCTION: Commissioner Milovich-Walters reported the Village is requesting a delay on the paving project of 121st Street until July 15, 2010. Work is currently being done at the Village pumping station relating to the expansion of the water reservoir project which is located at 121st and Southwest Highway. The delay would allow the contractor for the water reservoir expansion project to complete most of the concrete work thus saving the integrity of the new pavement by not having the heavy concrete trucks driving on it. K-Five Construction has no problem delaying the project but there could be an increase in asphalt costs associated with those delays.

Commissioner Milovich-Walters moved, seconded by Commissioner Polk, to approve paying additional costs which could be incurred for an increase in asphalt costs as a result of postponing the 121st paving project to K-Five Construction.

CHIPPING SERVICE: Commissioner Milovich-Walters reported the chipping truck will be out the week of May 3rd. Residents are asked to place their branches out by 7:00 a.m. Monday. Residents living along private roads with branches should call Public Works to schedule a pickup.

COMMISSIONER OF BUILDING & PUBLIC PROPERTY, JAMES PAVLATOS:
BUILDING DEPARTMENT REPORT: In Commissioner Pavlatos’ absence, Mayor Mahoney reported the Building Department issued 16 building permits totaling $11,597.13 in fees from April 7, 2010 through April 20, 2010. The Building Department conducted 25 building inspections. No certificates of occupancy were issued. No exaction fees were collected.

COMMISSIONER OF PUBLIC HEALTH AND SAFETY, DANIEL POLK:
PALOS PARK POLICE FOUNDATION: Pastor Lane Hensley, Church of the Tranfiguration and co-founder of the Palos Park Police Foundation, made a presentation to the Village Council about the foundation which was formed in March 2010 with the help of Carolyn Baca, former mayor and Police Commissioner. The Palos Park Police Foundation is a private/public partnership between the Police Department and the residents. It is the mission of the Foundation to prevent crime, save lives, and make our community a better and safer place to live and work by assisting the Palos Park Police Department with resources not available from the Village. Pastor Hensley stated the foundation is the first of its kind in Illinois and the only organization authorized to solicit funding on behalf of the Palos Park Police Department. All money raised will be used for equipment and training.

DOOR-TO-DOOR SOLICITING: Door-to-door solicitors must be registered with the Village of Palos Park. Residents can place a notice near the main entrance to their residence containing the words “No Unsolicited Material Invited”. Upon seeing the notice, solicitors must immediately and peacefully depart from the premises and leave no unsolicited material at such premises.

PALOS BANK HALF MARATHON: Commissioner Polk reminded residents the Palos Bank Half Marathon will be taking place on Sunday, May 2nd, on Route 83 between Harlem Avenue and Archer Avenue. Route 83 will be closed to all traffic on May 2nd from 6:00 a.m. – 11:00 a.m. to ensure a safe environment for the runners. Residents needing assistance with alternative routes, questions, and/or concerns are encouraged to call the Palos Park Police Department at 708-671-3770.

BICYCLE SAFETY: Commissioner Polk reminded residents that with warmer weather upon us, so are the bicycle riders. Commissioner Polk emphasized it is very important to wear your bike helmet as accidents can and do happen. Many children end up in emergency rooms because of bike injuries. A helmet will provide some protection for your head and brain in case you fall down. Residents can check out the police website at www.palosparkpolice.org for more safety tips.

COMMISSIONER OF ACCOUNTS AND FINANCE, MARY O’CONNOR:
CREDIT CARD POLICY AND REGULATIONS: Commissioner O’Connor stated the purpose of a credit card policy is to establish controls for the use of credit cards that will be assigned to and utilized by selected Village employees and officials to purchase goods and services.

Commissioner O’Connor moved, seconded by Commissioner Polk, to approve a credit card policy for the Village of Palos Park.

MAYOR’S REPORT:
RID LITTER DAY: Mayor Mahoney reported Rid Litter Day, sponsored by the Beautification Committee, was held on Saturday, April 24th. Boy Scouts, cub scouts, and residents go street by street picking up litter that has accumulated over the winter. Mayor Mahoney thanked everyone who helped clean up and was very appreciative for all the hard work Beautification Committee does throughout the entire year.

COMMITTEE REAPPOINTMENT: Mayor Mahoney requested Council consider reappointing Tom Donovan to the Police Pension Board.

VILLAGE NEWSLETTER: Mayor Mahoney reported the Village will resume mailing the newsletter to all Palos Park households beginning with the June/July issue.

RATIFICATION OF AGREEMENT BETWEEN THE VILLAGE AND PATRICIA JONES FOR CONTRACT EMPLOYEE SERVICES EFFECTIVE APRIL 1, 2010: Mayor Mahoney reported Administrator Jones will serve as interim Village Administrator beginning April 1, 2010 and ending approximately May 31, 2010. Administrator Jones retirement date was March 31, 2010. By contracting her services, it ensures continuity of services with the new Village Administrator, staff, and residents.

Commissioner Polk moved, seconded by Commissioner Milovich-Walters, to approve the ratification of the agreement between the Village of Palos Park and Patricia Jones for Contract Employee Services effective April 1, 2010.

VILLAGE ADMINISTRATOR AGREEMENT BETWEEN THE VILLAGE OF PALOS PARK THROUGH ITS VILLAGE COUNCIL AND RICHARD B. BOEHM FROM MAY 1, 2010 TO MAY 9, 2011: Mayor Mahoney announced Richard B. Boehm has been named the new Village Administrator for Palos Park. He was unanimously selected by the Village Council as Patricia Jones’ replacement. Richard Boehm is a former Village Manager of Oak Brook and Orland Park and currently works for McDonough Associates Inc., an engineering and architectural firm. Rick Boehm will begin on Monday, May 10th.

Commissioner Polk moved, seconded by Commissioner O’Connor, to approve the Village Administrator Agreement between the Village of Palos Park through its Council and Richard B. Boehm from May 10, 2010 to May 9, 2011.

CLERK’S REPORT:
CENSUS 2010: Clerk Bryson reported census takers will begin going door-to-door to approximately 1/3 of the households that did not mail back their census forms. Census workers will also verify that housing units indicated as “unoccupied” by the postal service or others are indeed unoccupied and vacant. The participation rate for Palos Park is currently at 83%.

ADMINISTRATORS REPORT:
AMENDMENTS TO THE VILLAGE SAFETY POLICY MANUAL, VILLAGE PERSONNEL POLICY MANUAL AND EMERGENCY ACTION PLAN: Administrator Jones explained that on March 18, 2010, Intergovernmental Risk Management Agency (IRMA) conducted their annual Regulatory Assistance visit. Department Directors met with Bill Crimmins to review IRMA’s safety and health regulatory requirements. To be fully compliant, the Village has established several changes to its Village Employee Manual, Safety Policy Manual and Emergency Action Plan.

Commissioner Milovich-Walters moved, seconded by Commissioner Polk, to approve the amendments to the Village Employee Manual, Safety Policy Manual, and Emergency Action Plan.

Commissioner Milovich-Walters moved, seconded by Commissioner Polk to:

1. TO APPROVE THE FIRST AMENDMENT TO THE MCCORD HOUSE LEASE FOR THE EXTENSION OF THE ORIGINAL LEASE FOR A SIX (6) MONTH PERIOD COMMENCING MAY 1, 2010 TO OCTOBER 31, 2010

2.TO APPROVE AMENDING THE NAME OF THE ILLINOIS FUNDS ACCOUNT FROM BUSINESS DISTRICT TO VILLAGE OF PALOS PARK POLICE ASSET FORFEITURE ACCOUNT

3. TO APPROVE PAYMENT OF INVOICES ON THE WARRANT LIST FOR APRIL 26, 2010 IN THE AMOUNT OF $122,249.55

Discussion was had regarding the extension of the McCord House Lease for a six (6) month period. It is the Tenant’s desire to amend the terms of the agreement and continue on a month-to month basis until terminated by either the landlord or the Tenant upon giving one (1) month prior written notice of termination. As such, the amendment to the McCord House Lease will be changed to reflect the Tenants desire to enter into a lease on a month-to month basis.

EXECUTIVE SESSION: In open session at 8:48 p.m., Commissioner Polk moved, seconded by Commissioner Milovich-Walters, to recess to executive session to discuss compensation of specific employees of the Village and setting the lease and/or sale price for property owned by the Village.
