MINUTES OF THE BOARD OF COMMISSIONERS’ MEETING
HELD ON JUNE 14, 2010
The Board
of Commissioners of the Village of Palos Park, Cook County, Illinois
held its regular meeting on Monday, June 14, 2010. Mayor Mahoney called
the meeting to order at 7:32 p.m. Answering to roll call were
Commissioners Milovich-Walters, Pavlatos, Polk, O’Connor, and Mayor
Mahoney.
Also in attendance were Carol Bryson, Village Clerk; Rick Boehm, Village
Administrator; Tom Bayer, Village Attorney; Barbara Maziarek, Finance
Director; Steve Manning, Community Development Director; Joe Miller,
Palos Park Police Chief; Kathy May, Deputy Clerk; and Cathy Gabel,
Deputy Clerk.
RECOGNITION OF EAGLE SCOUT JACOB HYNES: Mayor Mahoney recognized Jacob
Hynes with a Certificate of Recognition for his tremendous effort in
achieving Eagle Scout. Jacob received the rank of Eagle Scout in a
ceremony held on Sunday, May 16, 2010. Jacob has been involved in
scouting for many years and has dedicated countless hours to accomplish
this task. Congratulations Jacob!
RECOGNITION OF PASTOR LANE HENSLEY: Mayor Mahoney presented Pastor Lane
Hensley with a Certificate of Recognition for his service and
contributions to the community. Pastor Hensley has been with Church of
the Transfiguration for many years and most recently partnered with the
Palos Park Police Department by establishing the Police Chaplaincy
Program and just a few months ago helped establish the Palos Park Police
Foundation. The Police Chaplain brings experience, training and skills
to tragedies encountered in law enforcement. The Chaplain and police
officers work as a team making a difference in the lives of persons
touched by tragedy. The mission of the Police Foundation is to prevent
crime, save lives, and make our community a better and safer place to
live and work by assisting the Palos Park Police Department with
resources not available from the Village. Monies raised are used for
equipment and training. On behalf of the Palos Park Police Officers,
Detective Barry Churnin, recognized Pastor Hensley for all his hard work
with the Chaplaincy Program and Police Foundation by presenting him with
a plaque that reads “The men and women of the Palos Park Police
Department thank Lane Hensley for his dedication to the Police
Department and the community and his efforts in creating the Palos Park
Police Foundation”. Officer John Winter also thanked Pastor Hensley for
his support. As Commissioner of Public Safety, Dan Polk, extended his
deepest appreciation and thank you to Lane Hensley as he departs for his
new parish in Palm Desert, CA. Commissioner Polk wished him the best of
luck and great success. Pastor Hensley thanked everyone and was truly
overwhelmed by the support of the police officers.
APPROVAL OF MINUTES OF THE REGULAR COUNCIL MEETING HELD ON MAY 24, 2010:
Commissioner Polk moved, seconded by Commissioner Milovich-Walters, to
approve the minutes of the Regular Council Meeting held on May 24, 2010
as presented.

COMMISSIONERS’ REPORTS:
COMMISSIONER OF PUBLIC WORKS/RECREATION, NICOLE MILOVICH-WALTERS:
PUMP STATION AND WATER RESERVOIR EXPANSION PROJECT UPDATE: Commissioner
Milovich-Walters reported all four reservoir concrete walls have been
poured and forms removed, all interior support columns poured except
one, and scaffolding for the concrete roof is being installed.
Contractors will install rebar for the concrete roof and pour the roof
the week of June 14th. The roof will need four days to cure before
backfilling can take place. Commissioner Milovich-Walters stated the
contractors are approximately two weeks ahead of schedule.
DUMP TRUCK PURCHASE: Commissioner Milovich-Walters reported Public Works
budgeted for a new medium-sized dump-truck to be purchased through the ½
% Sales Tax Fund, Sewer Fund and Water Fund during Fiscal Year 2011. The
oldest of the Village’s trucks has been problematic for several years.
It has had six transmissions and is extremely unreliable especially
during the winter when operational use of the truck is essential for
snow removal. Quotes were obtained from three Ford Dealerships to
purchase a new 2011 Ford 5-550 under the government vehicle purchasing
plan and financed over five years. The quotes included the costs for
chassis, cab and all accessories. Commissioner Milovich-Walters
recommended to the Council that after reviewing the specifications and
quotes for the truck and a waiver of bids, purchasing of the vehicle be
made through Joe Rizza Ford of Orland Park (being the lowest responsible
quote) in the amount of $74,600.70.
Commissioner Milovich-Walters moved, seconded by Commissioner O’Connor
to waive bids and approve the purchase of the Ford F-550 under the
government vehicle purchasing program, financing to be done over five
years, and proportionally paid through the ½ % Sales Tax Fund, Sewer
Fund and Water Fund from Joe Rizza Ford of Orland Park in the amount of
$74,600.70.

ORDINANCE
AMENDING SANITARY SEWER AND WATER CONNECTION FEES: The ordinance
amending Village Code in relation to the sanitary sewer and water
connection fees is a revision in the water and sewer connection fee
chart contained therein.
Commissioner Milovich-Walters moved, seconded by Commissioner Pavlatos,
to adopt an Ordinance amending Part Ten, Title Four, Chapter 1040 and
1046 of the Palos Park Village Code in regard to sanitary sewer and
water connection fees.

TO APPROVE
INVOICE 3 AND PARTIAL WAIVER OF LIEN FROM AIRY’S FOR PUMP STATION
REHABILITATION AND RESERVOIR EXPANSION PROJECT: Commissioner Milovich-Walters
requested Council approve the third invoice and a partial waiver of lien
from Airy’s Inc. for work completed on the Pump Station Rehabilitation
and Reservoir Expansion Project through the period ending May 31, 2010.
The invoice covers excavation, steel reinforcement and concrete for the
reservoir walls, mechanical piping, and a portion of the electrical and
SCADA improvements. Airy’s is requesting payment in the amount of
$236,237.40.
Commissioner Milovich-Walters moved, seconded by Commissioner O’Connor,
to approve payment to Airy’s Inc. in the amount of $236,237.40 and a
partial waiver of lien for work completed through May 31, 2010 regarding
the Pump Station Rehabilitation and Reservoir Expansion Project.

COMMISSIONER OF BUILDING & PUBLIC PROPERTY, JAMES PAVLATOS:
BUILDING DEPARTMENT REPORT: Commissioner Pavlatos reported the Building
Department issued 13 building permits and 1 permit extension totaling
$8,494.05 in fees from May 19, 2010 through June 9, 2010. The Building
Department conducted 32 building inspections. One certificate of
occupancy was issued. No exaction fees were collected.
COMMISSIONER OF PUBLIC HEALTH AND SAFETY, DANIEL POLK:
BICYCLE HELMETS: Commissioner Polk announced the Palos Park Police have
received a monetary donation from a resident that will help them give
away free helmets to children this summer. The Helmet Giveaway Program
is a partnership with the medical profession to prevent child head
injuries. Head injuries are a major reason children visit hospital
emergency rooms each summer.
WEST NILE AND TICK BORNE DISEASES: Commissioner Polk reminded residents
to take precautions to avoid mosquito bites as it is the best way to
prevent West Nile and other mosquito-borne illnesses. Removing sources
of standing water can often reduce the number of mosquitoes in an area.
Commercial preparations are also available that are placed in standing
water and release a bacteria that is harmless to humans and fish but
kill the mosquito larvae.
FAMILY EMERGENCY ACTION PLAN: Commissioner Polk emphasized the need for
residents to make sure their families, neighborhood and community are
ready for emergencies and disasters should they strike. Families can put
together an emergency plan and a supply kit. Residents should be
prepared to help their neighbors and work together as a team to keep
everyone safe. For more information residents can go to www.ready.gov or

COMMISSIONER OF ACCOUNTS AND FINANCE, MARY O’CONNOR: Commissioner
O’Connor had no formal report this evening however, she read several
library announcements.
MAYOR’S REPORT:
MEMORIAL DAY AND FLAG DAY HIGHLIGHTS: Mayor Mahoney thanked the
Palos Historical Society, Palos Oak Hills Cemetery and Palos Park VFW
Post 4861 for their Memorial Day tributes honoring our fallen soldiers.
Events were held at both the Palos Oak Hills Cemetery and the Veteran’s
Memorial on the Village Green. Commissioner O’Connor attended the VFW
ceremony on the Village Green while the Mayor attended Memorial Day
tributes at the cemetery. Mayor Mahoney also thanked the Knights of
Columbus for their annual Flag Day Ceremony with the Great Lakes Navy
Band and the Western Lights Chorus. Their hard work made for a wonderful
evening of music, history and patriotism.
REMEMBERING MAYOR ROSEMARY KAPTUR: Mayor Mahoney asked for a moment of
silence to remember Rosemary Kaptur, former mayor of Palos Park who
passed away on May 29, 2010. Mrs. Kaptur served as mayor from 1978 to
1995. Her mayoral appointment in 1978 made her the Village’s first woman
mayor. Rosemary Kaptur was very much respected and served the Village
with class and grace and will truly be missed.
CLERK’S REPORT:
SENIOR CLUB UPDATE: Clerk Bryson reported the Senior Club is taking
a summer break resuming in September.
PALOS PARK VEHICLE STICKERS: Palos Park vehicle stickers, motorcycle
tags and dog tags are now available for purchase at the Kaptur
Administrative Center. The Kaptur Administrative Center is open Monday –
Friday from 9:00 am – 5:00 pm. Stickers must be displayed by midnight
June 30th.
VEHICLE STICKERS: Clerk Bryson reported 2010 Cook County vehicle
stickers for residents of unincorporated Cook County/Palos Township are
now available for purchase at the Palos Township Office, 10802 S.
Roberts Road. All residents in unincorporated Cook County/Palos Park
must purchase a vehicle sticker for every vehicle in their household,
including those that are kept in a garage. Stickers must be displayed by
July 1, 2010 otherwise a penalty which is double the sticker fee will be
applied. Clerk Bryson also reported vehicles registered to Palos Park
addresses must display a current Village sticker. Applications for the
2010-2011 stickers will be mailed this week. Palos Park vehicle stickers
must be affixed to the windshield by midnight June 30, 2010. Beginning
July 1, 2010 a $50.00 penalty fee will apply to residents who have not
purchased vehicle stickers.
FARMER’S MARKET: Clerk Bryson reported the Palos Park Woman’s Club will
sponsor the Farmer’s Market to be held every Friday beginning July 2,
2010 in the parking lot of the Palos Park Presbyterian Church located at
123rd Street and 88th Avenue.
“TASTE OF PALOS”: The Palos Park Woman’s Club annual “Taste of Palos”
will be held on Sunday, July 18, 2010. A variety of food and merchant
vendors will be on hand as well as entertainment and children’s
activities. Clerk Bryson invited everyone to join in on the festivities
to be held on the Village Green from 11:00 am – 7:00 pm.
ADMINISTRATORS REPORT: Administrator Boehm commented on the large number
of volunteers in our community and how wonderful it is to have them.
Administrator Boehm recognized Commissioner Polk, who will be helping
Public Works this summer and Clerk Bryson for her time at Village Hall
helping with administrative functions.

ILLINOIS, ASCERTAINING THE PREVAILING RATE OF WAGE FOR LABORERS, WORKMEN
AND MECHANICS EMPLOYED ON PUBLIC WORK OF SAID VILLAGE, PURSUANT TO 820
ILCS 130/1 ET.
2. PASS A RESOLUTION AUTHORIZING THE VILLAGE CLERK TO MAKE CERTAIN
CLOSED SESSION MINUTES AVAILABLE FOR PUBLIC INSPECTION – FIRST REVIEW
2010
3. APPROVE PAYMENT OF INVOICES ON THE WARRANT LIST FOR JUNE 14, 2010 IN

BUSINESS:
ZONING BOARD OF APPEALS RECOMMENDATION FOR BENEFICIARY OF LAND TRUST
OWNER OF PROPERTY AT 12003 S. 90TH AVENUE REGARDING REQUESTED VARIANCES
TO THE REQUIREMENTS IN CHAPTER 1464 OF THE VILLAGE CODE TO ERECT A NEW
FENCE IN THE REAR YARD:
The petitioner of property located at 12003 S. 90th Avenue has requested
variances to the requirements in Chapter 1464 to erect a new fence in
the rear yard be tabled to the June 28, 2010 Village Council meeting.
Commissioner Pavlatos moved, seconded by Commissioner Polk, to table the
Zoning Board of Appeals Recommendation regarding variances for a new
fence for property located at 12003 S. 90th Avenue to the June 28, 2010
Council meeting.

BUSINESS:
ORDINANCE AMENDING VILLAGE CODE IN REGARD TO PRIVATE STREETS: Plan
Commission held a public hearing on May 20, 2010 and recommended
approval of an amendment to Village Code allowing private streets if
they can meet two requirements. Private streets would need to be built
to the same standard as public streets as well as covenants that
obligate the lot owners to maintain the street. Commissioner Pavlatos
requested that Part Twelve, Title Four, Chapter 1246, Section 1246.05
(d) (4) be changed to read “if platted after June 14, 2010, and
providing access to three (3) or more buildable lots of record, the
easement width shall be at least sixty-six (66) feet and the roadway
pavement and related facilities within the easement shall be constructed
in accordance with the public street standards as set forth in Chapter
1248 of this Code”.
Commissioner Pavlatos moved, seconded by Commissioner Polk to adopt the
ordinance as presented with the change in Subsection 4 from a fifty (50)
foot easement width to a sixty-six (66) foot easement width.

ORDINANCE
AMENDING VILLAGE CODE IN REGARD TO PRIVATE STREET GUARD HOUSES AND
GATES: Commission held a public hearing on May 20, 2010 and recommended
amending Part Twelve, Title Four, Chapter 1248 in regard to private
street guard houses and gates. The new ordinance would allow new guard
houses and gates across new private street if they met several
conditions. Commissioner Pavlatos recommended that Part Twelve, Title
Four, Chapter 1248, Section 1248.03 subsection (l) be amended to read as
follows: Private Street Guard Houses and Gates For permanent access
easements platted after January 2004 that provide access to three (3) or
more lots and that comply with the requirements of Sections 1246.05 (d)
(4), (5) and (6) of this Code, a guard house and gate structures shall
be permitted within the access easement subject to compliance with the
following standards”.
Commissioner Pavlatos moved, seconded by Commissioner Milovich-Walters,
to adopt the ordinance as presented with the change of the date in
subsection (l) from June 14, 2010 to January 2004.

AMENDING VILLAGE CODE IN REGARD TO GARAGE LOCATIONS:
Plan Commission held a public hearing on May 20, 2010 and recommended
approval of an amendment to Village Code amending Part Twelve, Title
Six, Chapters 1268 and 1286 of the Palos Park Village Code in Regard to
Garage Locations. As stated in the ordinance, the Village of Palos Park
has the objective of regulating the location of garages to be compatible
with neighboring development and storm water management.
ORDINANCE AMENDING VILLAGE CODE IN REGARD TO DRIVEWAY LOCATIONS:
Plan Commission held a public hearing on May 20, 2010 and recommended
approval of an amendment to Village Code amending Part Ten, Title Two,
Chapter 1025 of the Palos Park Village Code in regard to driveway
locations. As stated in the ordinance, the Village of Palos Park has the
objective of regulating the location of driveways in side yards to be
compatible with neighboring development and storm water management.
ORDINANCE AMENDING VILLAGE CODE IN REGARD TO RETAINING WALL LOCATIONS:
Plan Commission held a public hearing on May 20, 2010 and recommended
approval of an amendment to Village Code amending Part Twelve, Title
Six, Chapter 1268 of the Palos Park Village Code in regard to retaining
wall locations. As stated in the ordinance, the Village of Palos Park
has the objective of regulating the location of retaining walls to be
compatible with neighboring development and storm water management.
Commissioner Pavlatos moved, seconded by Commissioner Milovich-Walters,
to adopt ordinances amending Part Twelve, Title Six, Chapters 1268 and
1286 in regard to garage locations, Part Ten, Title Two, Chapter 1025 in
regard to driveway locations, and Part Twelve, Title Six, Chapter 1268
in regard to retaining wall locations as written.

CERTIFICATE
OF CORRECTION IN REGARD TO FINAL PLAT OF SUBDIVISION FOR ROD ESTATES AND
AMENDING ORDINANCE 2005-24: Dale Rodriquez, resident and developer of
the subdivision known as Rod Estates, would like to change the name of
the subdivision to Hidden Oaks. A new plat will be prepared that would
be the same as the original plat recorded in 2005. It would include the
new name and a Certificate of Correction from the surveyor.
Commissioner Pavlatos moved, seconded by Commissioner Polk, to approve
the Certificate of Correction in regard to the Final Plat of Subdivision
for Rod estates and amending ordinance 2005-24.

PRELIMINARY
PLAT OF APPROVAL FOR CASTLES OF SHADOW LAKES: Commissioner Pavlatos
reported the Plan Commission recommended 6-0 to approve the preliminary
plat for the Castles of Shadow Lakes Subdivision. The subdivision will
be six (6) single family lots each over one (1) acre, private cul-de-sac
street, detention ponds, streetlights and guardhouse with entry gate.
Developer Casey Zubek of Side Enterprises in Chicago, will apply to
Illinois Environmental Protection Agency (IEPA) for sewer and water
connections, Metropolitian Water Reclamation District (MWRD) for
stormwater detention and the Cook County Highway Department. Mark
Daniel, attorney representing Side Enterprises spoke to Council briefly
describing the proposed subdivision and telling Council Mr. Zubek plans
to live in the proposed subdivision as well.
Commissioner Pavlatos moved, seconded by Commissioner Polk, to approve
the preliminary plat for Castles of Shadow Lakes Subdivision.

AUDIENCE
PARTICIPATION:
Mike Gaichas – 8502 121st Street, Palos Park, IL – Mr. Gaichas informed
residents of the 30th anniversary of “Taste of Chicago” to be held June
25- July 4, 2010 in Grant Park. Taste of Chicago has grown to be the
world’s largest outdoor food fest attracting nearly three million people
each year. Mr. Gaichas also spoke about Springfield, Illinois. In
addition to Springfield hosting the Illinois State Fair there are other
attractions including many sites devoted to our 16th President, Abraham
Lincoln. For more information about Springfield and area attractions

Maria Rogers – 12021 S. 93d Avenue, Palos Park, IL – Mrs. Rogers thanked
the Mayor, staff and Chief Miller for their attendance at the Palos Oak
Hills Cemetery Memorial Day Ceremony. Over 75 people participated.
ADJOURNMENT: There being no further business, Commissioner Milovich-Walters
moved, seconded by Commissioner Polk, to adjourn the meeting at 9:27
p.m.
