MINUTES OF THE BOARD OF COMMISSIONERS’ MEETING
HELD ON OCTOBER 10, 2011
The Board
of Commissioners of the Village of Palos Park, Cook County, Illinois
held its regular meeting on Monday, October 10, 2011. Mayor Mahoney
called the meeting to order at 7: 30 p.m. Answering to roll call were
Commissioners Milovich-Walters, Polk, Oliven, and Mayor Mahoney.
Commissioner Reed was not in attendance.
Also in attendance were Marie Arrigoni, Village Clerk; Rick Boehm,
Village Manager; Tom Bayer, Village Attorney; Michael Sibrava, Public
Works Director; Joe Miller, Palos Park Police Chief; Jacob Karaca,
Assistant Village Attorney; Barbara Maziarek, Finance Director; Julie
Fitzgibbons, Administrative Assistant and Cathy Gabel, Deputy Village
Clerk.
APPROVAL OF MINUTES OF THE REGULAR COUNCIL MEETING HELD ON SEPTEMBER 26,
2011: Commissioner Milovich-Walters moved, seconded by Commissioner
Oliven, to approve the minutes of the Regular Council Meeting held on
September 26, 2011 as presented.

RECOGNITIONS/PROCLAMATIONS/APPOINTMENTS/PRESENTATIONS:
NATIONAL SAVE FOR RETIREMENT WEEK: National Save for Retirement Week is
a national effort to raise public awareness about the importance of
saving for retirement. Goals for National Save for Retirement continue
to be awareness of retirement savings and to encourage employees to save
and participate in their employer-sponsored retirement plans. The week
provides employees an opportunity to reflect on their personal
retirement goals and determine if they are on target to reach those
goals. Mayor Mahoney proclaimed the week of October 16-22, 2011 to be
National Save for Retirement Week in Palos Park.
OCTOBER 2011 PALOS PARK ARTS & HUMANITIES MONTH: The month of October
has been recognized as National Arts and Humanities Month. Arts and
Humanities enhance every aspect of our lives, heighten our appreciation
of beauty and foster creativity and imagination. Mayor Mahoney
proclaimed the month of October as National Arts and Humanities Month in
Palos Park and called upon our citizens to celebrate and promote the
arts and culture in our community.

CONSENT AGENDA:
All items on the consent agenda are routine or have been brought forward
at the direction of the Board of Commissioners and will be enacted with
one motion. If discussion is desired, that item will be removed from the
consent agenda and considered separately.
Commissioner Milovich-Walters moved, seconded by Commissioner Oliven to:
A. To
adopt an Ordinance amending Ordinance No. 2007-42, adopted October
8, 2007, as amended by Ordinance No. 2009-22, adopted September 28,
2009, to extend the Temporary Special Use for an Off-Street Parking
Facility (Palos Community Hospital – three vacant lots located on
the North side of 123rd Place, East of McCarthy Road)
B. To approve payment of invoices on the Warrant List for October
10, 2011 in the amount of $75,298.51
C. To approve the Supplemental Warrant List dated October 10, 2011
for manual checks, payroll, and recurring wire transfers in the
amount of $323,732.78

INFORMATION
& UPDATES:
COMMISSIONER OF PUBLIC WORKS AND STREETS/RECREATION, NICOLE MILOVICH-WALTERS:
2011 PAVING IMPROVEMENTS PROJECT: Commissioner Milovich-Walters reported
Mt. Carmel Stabilization Group discussed with staff a pavement
reconstruction process called Full Depth Recycling (FDR). The process
pulverizes and reuses all the existing material in the pavement, base
and subgrade and mixes in a Portland Cement slurry to create a new base
that can be overlaid with a minimum amount of asphalt to create a
roadway with a twenty year life expectancy. Full Depth Recycling would
be used on streets that have deteriorated to a point where patching and
resurfacing is no longer a cost effective method of repair. A bid
opening was held today (Monday, October 10, 2011) for prequalified IDOT
contractors using the Full Depth Recycling process. Five (5) bids were
submitted. The lowest bid was submitted by Central Blacktop of LaGrange,
IL in the amount of $244,062.15.
Commissioner Milovich-Walters moved, seconded by Commissioner Oliven, to
award the 2011 Paving Improvement Project to the low bidder, Central
Blacktop Co., in the amount of $244,062.15 pending approval of the
contract by IDOT.

COMMISSIONER OF BUILDING & PUBLIC PROPERTY, G. DARRYL REED:
BUILDING DEPARTMENT REPORT: Mayor Mahoney reported in Commissioner
Reed’s absence the Building Department issued 4 building permits
totaling $240.00 in fees from September 21, 2011 through October 5,
2011. The Building Department conducted 26 inspections. No Certificates
of Occupancy were issued. No exaction fees were collected. To date, Tree
Bank Fund remains at $6,775.00.
COMMISSIONER OF PUBLIC HEALTH AND SAFETY, DANIEL POLK:
PALOS PARK POLICE OFFICERS TO RECEIVE SHERIFF’S AWARDS: Commissioner
Polk announced Palos Park Police Officers John Winter, Tony Loiacono and
Matt Novak will receive the 2011 Sheriff’s Award of Valor on November
15, 2011. The Sheriff’s Award of Valor recognizes the outstanding work
of police officers throughout Cook County.
PRESCRIPTION DRUG TAKE-BACK DAY: The Drug Enforcement Administration
(DEA), public health and law enforcement partners have announced a
nationwide prescription drug “Take-Back” initiative to prevent increased
pill abuse and theft. The DEA will be collecting expired, unused and
unwanted prescription drugs for destruction at sites nationwide on
Saturday, October 29, 2011 from 10:00 a.m. – 2:00 p.m. There is no
charge for the service and no questions are asked. The Palos Park Police
Department is a drop-off site for the prescription drugs.
PROJECT LIFESAVER PROGRAM: Commissioner Polk announced Project Lifesaver
will be coming to Palos Park. The program provides enhanced support and
assistance to Palos Park residents who are primary caregivers for
individuals with Alzheimer’s, dementia related disorders, children with
Down Syndrome, autism or cognitive impairments. Participants wear a
special wrist or ankle bracelet equipped with a small transmitter which
emits a signal that law enforcement can track should they go missing.
More details will follow as the program gets implemented.
HALLOWEEN SAFETY: Commissioner Polk offered safety tips make Halloween
safe. Tips include: wearing light-colored clothing, making sure you can
see through face masks or use make-up, carrying a flashlight, only
accept wrapped or packaged candy and staying away from pets as they may
not recognize you and become frightened.
COMMISSIONER OF ACCOUNTS AND FINANCES, KENT OLIVEN: Commissioner Oliven
had no formal report this evening however, he read several library
announcements.
MAYOR’S REPORT:
RESOLUTION TO REFRAIN FROM REDUCING STATE COLLECTED LOCAL GOVERNMENT
REVENUES: Proposals were introduced during the Spring 2011 Legislative
Session to reduce the Local Government Distribution Fund (LGDF) and to
divert the Corporate Personal Property Replacement Tax money away from
the municipalities.
Commissioner Milovich-Walters moved, seconded by Commissioner Oliven, to
pass a resolution to Refrain from Reducing State Collected Local
Government Revenues.

RESOLUTION
TO EXTEND THE WIRELESS EMERGENCY TELEPHONE SAFETY ACT: The Wireless
Emergency Telephone Safety Act will expire on April 1, 2013. The act
authorizes the collection and distribution of surcharge funds to local
911 systems. Monies generated by the surcharge are used to fund
operations and improvements to the 911 systems. There are over 200 911
systems in Illinois that relay emergency information to public safety
agencies.
Commissioner Polk moved, seconded by Commissioner Milovich-Walters, to
pass a resolution to extend the Wireless Emergency Telephone Safety Act.

RESOLUTION
TO EMPOWER MUNICIPALITIES TO ADDRESS FORECLOSED PROPERTIES THROUGH
LEGISLATIVE ACTION: Foreclose properties can cause serious problems in
municipalities when allowed to follow into disrepair. This resolution
requests the Governor and General Assembly approve legislation that will
provide financial assistance and authority to secure vacant property.
Commissioner Oliven moved, seconded by Commissioner Milovich-Walters, to
pass a resolution to Empower Municipalities to Address Foreclosed
Properties Through Legislative Action.

RESOLUTION
TO REPEAL P.A. 95-490: P.A. 95-490 limits the ability of municipalities
and fire districts to supplement full time firefighters with volunteer
or part time firefighters. A repeal of the Act will allow departments
and districts to re-establish their use of volunteer and part time
employees as a mandatory subject of bargaining under Illinois Public
Labor Relations Act (IPLRA).
Commissioner Oliven moved, seconded by Commissioner Milovich-Walters, to
pass a resolution to repeal P.A. 95-490.

RESOLUTION
TO REDUCE THE FINANCIAL BURDEN IMPOSED BY THE PUBLIC SAFETY BENEFITS ACT
(PSEBA): Currently, under the Public Safety Employee Benefits Act,
police officers and firefighters suffering a “catastrophic injury” are
entitled, along with their spouses and eligible minors, to receive
lifetime health insurance coverage paid for by municipal governments and
their taxpayers. As health insurance costs continue to rise and
municipalities struggle to provide employees with quality and affordable
health insurance, this resolution request the governor and General
assembly approve legislation that reduce s the financial burden that
PSEBA imposes on municipal governments.
Commissioner Oliven moved, seconded by Commissioner Milovich-Walters to
pass a resolution to Reduce the Financial Burden Imposed by the Public
Safety Benefits Act (PSEBA).

RESOLUTION
TO ADDRESS PUBLIC SAFETY PENSION SUSTAINABILITY: Mayor Mahoney explained
this resolution requests the State Legislature introduce reform measure
for police and fire pension systems.
Commissioner Oliven moved, seconded by Commissioner Milovich-Walters, to
pass a resolution to Address Public Safety Pension Sustainability.

RESOLUTION
TO ALLOW ALL ARTICLE 3 OR 4 PENSION FUNDS TO INVEST UP TO 55% OF ASSETS
IN DIVERSIFIED EQUITY MUTUAL FUNDS AND TO REMOVE RESTRICTIONS ON MUTUAL
FUNDS OF BONDS OR MONEY MARKET INSTRUMENTS THROUGH LEGISLATIVE ACTION:
This resolution requests the governor and General Assembly approve
legislation allowing Article 3 or 4 pension funds to invest up to 55% of
assets in mutual funds comprised of diversified portfolios of common or
preferred stocks and to remove restrictions on mutual funds of bonds or
money market instruments.
Commissioner Oliven moved, seconded by Commissioner Milovich-Walters, to
pass a resolution to Allow all Article 3 or 4 Pension Funds to Invest up
to 55% of Assets in Diversified Equity Mutual Funds and to Remove
Restrictions on Mutual Funds of Bonds or Money Market Instruments
through Legislative Action.

CLERK’S
REPORT:
CVS PHARMACY FLU SHOTS: Clerk Arrigoni thanked the representatives of
CVS Pharmacy for sponsoring free flu shots for seniors on Wednesday
September 21st at the Recreation Center.
FARMER’S MARKET: Clerk Arrigoni reported the Farmer’s Market ended
Friday, October 7th and thanked everyone for their continued support.
VILLAGE MANAGER’S REPORT: Manager Boehm had no formal report this
evening.
CITIZENS AND VISITORS COMMENT PERIOD:
Maria Rogers – 12021 S. 93rd Avenue, Palos Park, IL – Mrs. Rogers
informed Council and residents of the passing of Robert Mahaffay.
Services will be held on October 11, 2011 at Palos Park Presbyterian
Community Church. Robert J. Mahaffay was born to one of the pioneer
families of Palos Park, and was the son of J.W. Mahaffay, the third
Mayor of Palos Park.
